浙江大学紫金港校区西区基本建设指挥部：
    你部这次组织的“体育馆-动力中心增容工程”的招标（项目编号：2005-168）其中招标文件的有些条款是不合理，不公正的。
招标文件第二章，3·2·5·2（5）
    本工程的制冷主机因为必须与原紫金港东区动力中心制冷主机相匹配，本次招标新增的2台制冷主机必须采用美国约克品牌。不按此品牌投标的按废标处理。（实质性条款）
    国内市场，此类设备厂家产品销售分区，一个地区只授权一个代理商，不能跨区拦业务。一个项目只授权一家销售。约克更是对每个项目“一夫一妻制”。
　　　如果你们对市场这个情况不了解，说明你们孤陋寡闻，无意出错。
　　　如果知道市场有这样的销售模式，再编制如此条款，这个性质就不一样了。
    如果这一条款内容在招标公告中预先告知欲投标人，这样的运作是正常的。
    如果先没有让投标人知道这一条款内容，在投标人申报投标，买了招标文件后才能知道这一条款内容，这个性质也是不一样的。
    对此，投标人可以这样认为：
1、如预先知道该条款内容，投标人或许不会申报投标，不去购买招标文件。招标人的作为是招引尽可能多的投标人购买招标文件，收回招标文件编制成本。
2、凑足投标人数，使招标行为表面合法化。
3、招标人与某个投标人串标，达成某种默契。因为产品设备独家经销，投标人可以随意开价。
4、招标人以“招标文件第二章，3·2·5·2（5）”条款为根据，评标只有一个有效标，其他都是废标，使某个投标人自然中标。
    以上4点没有证据，只是怀疑和猜测。
建议：
召回售出的招标文件，赔偿投标人的损失。
划出制冷主机，重新招标。
项目可以不招标。
原设计应该知道，可以选装其他品牌制冷主机，装后与原系统联动运行不会有问题。
