有个工程，标书只设定一个中标候选人，评标委员会按照标书规定推荐了一名中标候选人。公示期内，有人投诉该中标候选人涉嫌造假骗取中标，经建设行政主管部门查实，该中标候选人被裁决中标无效。现在业主面临的问题是，唯一的中标候选人被宣布中标无效后，是应该从其他投标人中重新评标确定中标人还是重新招标。由于招标文件对出现此类情形没有明确规定，相关部门在处理该案件时争议很大，请问各位，哪种方法更好？

  唯一中标候选人涉嫌造假骗取中标，应从其他投标人中依据招标文件规定的评标方法、内容、标准和授予合同条件，选择新的中标候选人，最好是三个，并排序，以便招标人确定中标人。正确的做法，应进一步评标，而不是重新招标。否则对其他投标人是不公正的，因他们的投标方案和投标价格都已经公开，重新招标时，使他们处于不利的竞争地位。
  但是如果已经超过投标有效期或超过投标保证金有效期，并已经退还投标保证金时，就只能重新招标了。由于重新招标是在原招标被终止的情况下，因此应给所有投标人（不包括涉嫌造假骗取中标的投标人）以补偿其损失。
  以上个人意见，仅供参考。
